7. Client Bot Data

When we build a bot for your business, your customers' messages to your bot are processed to generate AI responses. This data is used solely to operate your bot and is not shared with other clients or third parties.

Terms & Conditions

1. Agreement

By engaging the services of SmartBot Builds Enterprises ("we", "us", "our"), you ("Client") agree to these Terms and Conditions. These terms govern all services provided including AI WhatsApp bot development, delivery, and support.

2. Services

SmartBot Builds Enterprises provides custom AI WhatsApp bot development services. The specific deliverables, timeline, and pricing for each project are agreed upon before work begins.

3. Payment Terms

• A deposit of 50% of the agreed project fee is required before work begins
• The remaining 50% balance is due upon delivery and client approval
• Payment is accepted via Bank Transfer, Opay, or Palmpay
• Work will not commence until the deposit payment is confirmed

4. Delivery Timeline

Delivery timelines begin from the date the deposit is received AND all required client information (business details, products, FAQs, etc.) has been provided. Delays in providing information will extend the delivery timeline accordingly.

5. Revisions & Updates

• Minor edits are included free of charge for 7 days after delivery
• After the 7-day period, updates are charged per task as per our update pricing
• There are no mandatory monthly fees
• Clients may optionally subscribe to a support retainer at an agreed monthly rate

6. Client Responsibilities

The client is responsible for:

• Providing accurate and complete business information required to build the bot
• Ensuring they have the right to use their WhatsApp number for the bot
• Complying with WhatsApp's Business Policy and Terms of Service
• Ensuring the bot is used only for lawful business purposes

7. Intellectual Property

Upon full payment, the client owns the delivered bot workflow and configuration. SmartBot Builds Enterprises retains the right to use non-identifying project details for portfolio and marketing purposes.

8. Limitation of Liability

SmartBot Builds Enterprises shall not be liable for:

• Any downtime or service interruptions caused by WhatsApp, Meta, or third-party providers
• Loss of business or revenue resulting from bot unavailability
• Changes to WhatsApp's API or policies that affect bot functionality
• Any indirect, incidental, or consequential damages

9. Refund Policy

• The deposit is non-refundable once work has commenced
• If the project is cancelled before work begins, the full deposit will be refunded
• The balance payment is due only after the client confirms delivery is satisfactory

10. Confidentiality

We treat all client business information as confidential. We will not share your business details, product information, or customer data with third parties except as necessary to deliver the service.

11. Governing Law

These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved through good-faith negotiation, and if necessary, through Nigerian courts.
